1. Acceptance of Terms
Please read these Terms of Service ("Terms") carefully. By creating an account, accessing, or using the chatwithlily (or "Lily") mobile application ("Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, strictly do not use the Service.
2. Medical Disclaimer (CRITICAL)
CHATWITHLILY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
The insights, feedback, and conversations generated by our AI are for informational, emotional support, and entertainment purposes only. They do not constitute professional medical advice, diagnosis, or treatment.
No Doctor-Patient Relationship: Using Lily does not create a doctor-patient relationship.
Accuracy: The AI may produce "hallucinations" or inaccurate information. You should not rely on the AI for critical health decisions.
Emergency: If you are in crisis, experiencing a medical emergency, or considering self-harm, STOP using the App immediately and call 988 (US), your local emergency services, or go to the nearest emergency room.
3. User Accounts
Eligibility: You must be at least 13 years old to use the Service.
Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
4. User Content and License
Ownership: You retain full ownership of the journal entries, text, and audio ("User Content") you upload.
License to Us: By using the Service, you grant Longwu Liang a worldwide, non-exclusive, royalty-free, perpetual license to use, store, reproduce, modify, and process your User Content solely for the purpose of operating, developing, and improving the Service.
AI Training: You explicitly agree that we may de-identify and aggregate your User Content (so it is no longer linked to you) and use such anonymized data to train our AI models and algorithms.
5. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose.
- Upload content that is hateful, violent, pornographic, or harassing.
- Attempt to reverse engineer the App or interfere with our servers.
- Use the App to generate content for a competing service.
We reserve the right to suspend or terminate your account immediately if you violate these rules.
6. Subscription and Billing
Subscriptions: Some features require a paid subscription ("Premium"). Subscriptions are billed on a monthly or annual basis.
Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Cancellations: You can manage and cancel subscriptions in your Apple ID or Google Play Store settings.
Refunds: All purchases are final. Refunds are handled exclusively by the platform (Apple or Google) according to their refund policies. We cannot issue refunds directly.
Modifications to the Service: We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Longwu Liang shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
7. Intellectual Property
The App, including its design, code, "chatwithlily" text, and graphics, is the property of Longwu Liang and is protected by copyright laws. You are granted a limited, non-sublicensable license to use the App for personal use.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LONGWU LIANG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. You acknowledge that AI responses are generated automatically and may occasionally be coherent but factually incorrect, offensive, or biased. Longwu Liang does not endorse and disclaims liability for any AI-generated content.
9. Indemnification
You agree to defend, indemnify, and hold harmless Longwu Liang from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Hong Kong SAR, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be settled by the courts located in Hong Kong.
10.1 Severability and Entire Agreement
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
Entire Agreement: These Terms, together with the Privacy Policy and Paid Service Agreement, constitute the entire agreement between you and Longwu Liang regarding the Service.
11. Apple-Specific Terms (Required for iOS App)
If you download the App from the Apple App Store, the following applies:
- These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any third-party claim that the App infringes their intellectual property rights, we, not Apple, will be responsible for the investigation and discharge of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
